The purpose of this research is to analyze the application of criminal sanctionsagainst the perpetrators of the crime of murder, the factors that cause theoccurrence of the crime of murder, and the judge's considerations in decidingacase in the crime of murder. that have never been studied and discussedbyprevious researchers. This study uses a normative juridical approachwithdescriptive analysis research specifications that describe the applicable laws andregulations associated with legal theories. The stages in this research are dividedinto two stages, namely library research and field research. The conclusionsdrawn from the research results were carried out through a qualitative normativejuridical method. The results of economic research, low education, technological developments, and directly in the form of revenge, and negligence of theperpetrators. And the judge has decided that the convict on behalf of Aris BinAlm Manaf fulfills the elements of criminal responsibility, both the abilitytoberesponsible, intentional and forgiving reasons so that he deserves to be sanctionedin accordance with Article 338 of the Criminal Code.
